§ 16-54. Motorboat activity prohibited in Occoquan Reservoir.

  • (a)

    It shall be unlawful for any person to operate any boat on the Occoquan Reservoir having a motor or motors, singly or in combination, of more than ten horsepower, provided that this subsection shall not apply to any boat, regardless of the horsepower of its motor or motors, which is owned or granted by any public agency or authority, which is used exclusively for emergency or rescue purposes, or which is used exclusively to transport platforms, barges, or vessel hulls to stationary positions on the Occoquan Reservoir for use in connection with races or other sporting events.

    (b)

    For the purposes of this section, the following terms shall have the meanings respectively set forth:

    (1)

    Boat shall mean any and all boats, crafts, vessels, or devices for use on or in water.

    (2)

    Motor shall mean any type of internal combustion machinery which is used as the sole or auxiliary motive power for a boat, and includes, but is not limited to, inboard engines, outboard motors and jet drive motors.

    (3)

    Operate shall mean to navigate or otherwise use a motorboat or vessel.

    (4)

    Occoquan Reservoir shall mean those portions of the Occoquan Reservoir (also known as Occoquan Creek) and Bull Run which lie within this county:

    a.

    Between the Fairfax County Water Authority Low Dam (downstream terminus) and Lake Jackson Dam on the Occoquan River; and

    b.

    Between the mouth of Bull Run and the Southern Railroad crossing of Bull Run. The term includes tributaries thereto a point two miles from the receiving stream.

    (c)

    Any person who violates any provision of this section shall be guilty of a Class 2 misdemeanor.
